Definitions
Entity: Refers collectively to Domus Curata, a brand owned and operated by Bennet & Darcy, Inc., domuscurata.com, a website owned and operated by Bennet & Darcy, Inc., Bennet & Darcy, Inc. (the parent corporation), and Christopher Myers (President of Bennet & Darcy, Inc.).
Client: Refers to the individual or organization booking and participating in the consultation.
Consultation: Refers to the 30-minute Introductory Textile Care Assessment via Zoom.
Payment and Booking Terms
Advance Payment Required: Full payment of $500 must be made at the time of booking to secure the appointment. Accepted payment methods include all major credit cards. No booking is confirmed until payment is received.
Fee Structure: The $500 fee covers a 30-minute Zoom consultation focused on an introductory assessment of the Client's textile care needs, including personalized advice based on the Client's description of their items or concerns.
Cancellation and Refund Policy
Client Cancellation:
If canceled by the Client at least 48 hours before the scheduled start time, a full refund will be issued (minus any processing fees, e.g., 3-5% for credit card transactions).
If canceled between 24-48 hours in advance, a 50% refund ($250) will be issued.
If canceled less than 24 hours in advance or if the Client is a no-show (defined as not joining the Zoom meeting within 10 minutes of the start time without prior notice), there will be full forfeiture—no refund will be provided. This policy ensures commitment to the scheduled time while allowing reasonable flexibility.
Entity Cancellation: If the Entity is unable to attend for any reason (e.g., illness, technical issues, or emergency), the Client will receive a 100% refund.
Rescheduling: Clients may request to reschedule once with at least 24 hours' notice at no extra charge, subject to the Entity's availability. Additional reschedules may incur a $100 administrative fee.
Meeting Logistics and Expectations
Duration and Format: The session is strictly 30 minutes via Zoom. The Entity will provide the Zoom link in the booking confirmation email. Clients should test their setup in advance; technical issues on the Client's end do not qualify for refunds.
Preparation Requirements: Clients are encouraged to prepare questions, photos, or descriptions of their textiles in advance to maximize the session's value. If additional time is needed, it can be discussed during the call and booked as a follow-up service at the Entity's standard rates.
Time Zone: All appointments are scheduled in Hawaii time. Clients are responsible for converting to their local time.
Recording Policy: The Entity may record the session for internal purposes (e.g., quality assurance or reference) without prior consent. The Client may not record the session without the Entity's written consent to protect privacy and intellectual property.
Additional Protections and Suggestions
Confidentiality: The Entity appreciates that many Clients may be highly recognizable individuals or entities with strict NDA requirements. All information shared during the consultation (e.g., details about valuable textiles, personal collections, or sensitive contexts) will be treated as strictly confidential and not shared without explicit permission. If needed, the Entity is happy to discuss or sign a customized NDA prior to the session to align with the Client's requirements.
Risks and Liability Waiver: Textile care, preservation, and maintenance inherently involve some risks due to the delicate nature of textiles, including but not limited to degradation, discoloration, or unintended damage from environmental factors, handling, or application of recommended methods. The Client acknowledges these inherent risks and voluntarily assumes all responsibility for them. Any damage or perceived damage that occurs to any textiles as a result of actions taken or not taken based on communication with or direction by the Entity, its affiliates, employees, or agents, is the sole responsibility of the Client. By accepting these terms, the Client hereby releases and forever discharges the Entity from any and all liability, including but not limited to claims for negligence, errors, omissions, breach of contract, or any other cause of action. The Client waives all rights to sue, bring any legal action, or assert any claims (including damages and otherwise) against the Entity. Furthermore, the Client agrees to indemnify and hold harmless the Entity from any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising from or related to the Client's use of the advice provided, including third-party claims. This waiver extends to the Client's heirs, successors, assigns, and representatives.
Scope Limitations: This introductory assessment is advisory only and does not constitute a formal appraisal, guarantee of results, or hands-on service. Recommendations are based on the information provided and the Entity's expertise.
Dispute Resolution: Any dispute, claim, or controversy arising out of or relating to these terms, the consultation, or any related services ("Disputes") shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days, the parties agree to submit the Dispute to non-binding mediation administered by a mutually agreed-upon mediator (or, if no agreement, under the rules of the American Arbitration Association [AAA]) in Fairfax County, Virginia, USA. If mediation fails, Disputes shall be resolved exclusively in accordance with the laws of the Commonwealth of Virginia, USA, without regard to its conflict of laws principles. Jurisdiction and venue for any legal action shall be brought exclusively in the courts located in Fairfax County, Virginia, USA. The prevailing party in any Dispute shall be entitled to recover its reasonable attorney’s fees and court costs from the non-prevailing party. Both parties hereby waive any right to a jury trial in connection with any Dispute. Refunds will be processed within 7-10 business days via the original payment method.
Force Majeure: Neither party is liable for failures due to events beyond control (e.g., natural disasters, internet outages), but reasonable efforts will be made to reschedule or refund.
Severability: If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Acknowledgment: Clients must confirm they have read and agreed to these terms before booking.
